Informing Note to the Candidates on Personal Data Processing
Dear candidate,
For your information please, allow us to provide the following:
(i) Sending by you of your contact details and / or your professional activity resume, your professional summary, as the case may be, for the purpose of a possible activity within the Romanian Law Firm “Hristescu & Partners” headquartered at 39 Primăverii Blvd., 4th floor, 5th app., Bucharest, (“HMP”) will also mean processing by HMP as controller, in the meaning of the EU Regulation (general) on Personal Data, 2016 / 679 (“GDPR”), of your personal data (“Personal Data”), as the case may be:
- your family name, first name, e-mail address used by you to communicate with us, your e-accounts, mobile phone number, your actual professional position,as candidate (“Data Subject”), for the recruitment purpose for a possible collaboration with HMP;
- data regarding your professional activity and performance, professional collaborations and evolution, your qualifications, attended trainings/courses / professional trainings, skills and competences, professional knowledge of a certain type, areas of practice, others like these, necessary in the recruitment and selection process.
- data that HMP can obtain according to the law by querying public databases /registers, public records such as the public available list of lawyers;
- other data, information and possible identifiers you provide during communication of the CV, your intention of collaboration, within the discussions held as interview.
(ii) HMP uses the Personal Data entrusted by you as candidate or available to it, following your availability announcement, for the main purpose of recruiting for a position / a possible collaboration between you and HMP.
(iii) HMP processes your personal data according to the principles stipulated by the provisions of the EU Data Protection Regulation (general) 2016/679 , on the main legal basis of negotiating a possible collaboration agreement with you, according to the specifics of the lawyers profession and its professional and statutory rules, if the case on the basis of negotiation and conclusion of a labor agreement, as per the legal requirements applicable to its activity, if necessary on the basis of achieving its legitimate interest, to be able to exercise and defend its own rights within this activity , respectively based on your consent legal ground for a subsequent storage of your CV / professional summary, if you have expressed one ( legal grounds for processing ).
(iv) HMP uses Personal Data and performs processing for the above- mentioned and announced legal basis and purposes, by manual means, by written electronic means, as well as by both means, as may be necessary.
(v) We retain your personal data on the duration of the recruitment process, exceptionally later if you have provided your consent to do so, within the duration of your consent.
(vi) Your Personal Data may be accessed within the retention period of time by the IT&C maintenance company if needed appropriate for the maintenance, by authorized lawyers, if required by institutions as per the law.
(vii) The Data Subject (you in this case) in relation to HMP has the right to access personal data, the right to rectify and complete the data , the right to delete the data [ “the right to be forgotten” ( however, we specify that may be exceptional circumstances in which HMP cannot comply with the request to delete data)], the right to restrict data processing , the right to data portability (when portability is technically feasible), the right to object ( please note that HMP does not perform processing for advertising / marketing purposes), the right to withdraw consent if it has been granted for data processing.
For the avoidance of doubt, at this moment HMP does not use an automated processing tool of Personal Data for profiling purposes, so that to take a decision regarding Data Subject.
We will be delighted to respond to Data Subjects’ requests to the exercise their rights in relation with HMP, requests which can be sent to HMP on the address of the HMP headquarters or by fax to + 40 317 110 202, or by e-mail at gdpr@hmpartners.ro .
Data Subject may submit his/her complaint to the local Supervisory Authority, A.N.S.P.D.C.P., respectively to the competent court.

Spre informarea dvs. va transmitem următoarele:
(i) Comunicarea de către dvs. a datelor de contact și/sau a CV-ului, rezumatului profesional, după caz, în scop de colaborare profesională cu SCPA HRISTESCU SI ASOCIAȚII cu sediul in București, sector 1, B-dul Primăverii nr.39, et.4, ap.5 („HMP”), va însemna prelucrare implicită, ca operator in accepțiunea Regulamentului UE (general) privind protecția datelor 2016/679 (“GDPR”), de date cu caracter personal („Date Personale”), după caz:
- nume, prenume, adresa de e-mail de pe care ne comunicați, pagina electronica sau cont de prezentare, număr de telefon mobil, poziția profesională actuală a dvs. , în calitatea dvs. de candidat („Persoana Vizata”) și în scop de recrutare pentru o posibila colaborare cu HMP;
- date privind situația și performanta dvs. profesională, colaborări și evoluție profesionale, calificări obținute, cursuri absolvite/formare profesională, abilități si competențe, cunoștințe profesionale de un anumit tip, domenii de practică, alte asemenea, necesare in realizarea recrutării si selecției;
- date pe care HMP le poate obține conform legii prin interogarea unor baze publice de date/registre, evidențe publice precum tabloul avocaților;
- alte date, informații și posibile elemente de identificare pe care le furnizați cu prilejul comunicării CV-ului, intenției dvs. de colaborare, a discuțiilor purtate in scop de interviu.
(ii) HMP utilizează Datele Personale care ii sunt încredințate de către dvs. in calitatea dvs. de candidat sau la care are acces potrivit disponibilității anunțate de către dvs., in scopul principal al recrutării pentru o poziție/o colaborare a dvs. cu HMP.
(iii) HMP prelucrează datele cu caracter personal potrivit principiilor stipulate de prevederile Regulamentului UE (general) privind protecția datelor 2016/679, in temeiul principal al negocierii unui posibil contract de colaborare cu dvs. conform celor specifice profesiei de avocat și normelor profesionale și statutare, daca este vorba de angajare pentru o alta poziție/activitate, in temeiul negocierii si încheierii unui contract de muncă, în baza cerințelor legale aplicabile activității sale, dacă este cazul pentru realizarea unui interes legitim propriu, pentru a-si putea exercita și apăra drepturile referitor la activitatea astfel desfășurată, în baza consimțământului dvs. pentru stocarea ulterioară a CV-ului/rezumatului profesional, daca v-ați exprimat un astfel de consimțământ (temeiuri legale de prelucrare).
(iv) HMP utilizează Datele Personale si realizează o prelucrare implicita pentru scopurile și în temeiurile legale sus-menționate si anunțate, folosind atât mijloace manuale, scriptice dar si mijloace electronice, precum și mixte, după caz.
(v) Stocăm datele dvs. cu caracter personal pe durata recrutării, eventual ulterior, cu titlu de excepție, daca v-ați exprimat consimțământul in acest sens, pe durata consimțământului.
(vi) Pot avea acces la Datele Personale ale dvs. pe durata stocării și compania de mentenanță si întreținere IT&C când este cazul, avocați colaboratori, instituții autorizate daca solicita in limitele si conform legii.
(vii) Persoana Vizată (dvs. in acest caz) in relația cu HMP are dreptul de acces la datele cu caracter personal, dreptul la rectificarea și completarea datelor, dreptul la ștergerea datelor [“dreptul de a fi uitat” (cu precizarea ca vor putea fi însă excepțional situații in care HMP să nu poată da curs solicitării de ștergere a datelor)], dreptul la restricționarea prelucrării datelor, dreptul la portabilitatea datelor (când portabilitatea este fezabilă din punct de vedere tehnic), dreptul de opoziție (cu mențiunea ca HMP nu efectuează prelucrări in scop publicitar/de marketing), dreptul de retragere a consimțământului dacă acesta a fost acordat in vederea prelucrării datelor.
Pentru evitarea oricărui dubiu, HMP nu utilizează la data prezentului un sistem automatizat de prelucrare a Datelor Personale ori de prelucrare in scop de profilare, care sa duca la luarea vreunei decizii in privința Persoanei Vizate.
Vom fi încântați să răspundem cererilor Persoanelor Vizate de exercitare a drepturilor lor pentru relația cu HMP, cereri care pot fi adresate HMP pe adresa sediului HMP sau la nr. de fax +40 317 110 202 ori prin e-mail la gdpr@hmpartners.ro.
Persoana vizată se poate adresa cu plângere Autorității locale de supraveghere, A.N.S.P.D.C.P, respectiv instanței competente.
